Agreement of Temporary Luggage Storage

This agreement is to specify the rules in relation to “temporary luggage storage service” (hereinafter referred to as “temporary luggage storage”) provided by Mikuraya Shoji Co., Ltd. (hereinafter referred to as “Mikuraya” or “we”). Please note that customers cannot use the temporary luggage storage if they do not agree to the agreement.

  1.  Application
    After presenting some form of identification, customers must submit the following items to Mikuraya for their application.
    (1)  Name, address, telephone number and email address
    (2)  Emergency contact (phone number other than the customer’s, and the contact of their own country would be fine.)
    (3)  Size, quantity
    (4)  Date of return, return address
    (5)  Other items that Mikuraya specifies
      In case changes occur to the items above, the user must report them to Mikuraya swiftly.
  2. Locking when checking in
      Customers shall deposit luggage while keeping it locked. In some cases, an unlocked bag cannot be checked in.
  3. Things that cannot be stored
    (1) Mikuraya doesn’t keep things other than luggage. Things that don’t fit luggage and cardboard boxes are the ones that customers cannot check-in.
    (2) In case the luggage contains the following items, Mikuraya shall not keep the luggage.
    a. Valuables (cash, passport, cash cards, prepaid cards, credit cards, securities, jewelry, precious metals, calligraphies, antiques, art crafts etc.)
    b. Frozen/refrigerated food
    c. Animals, plants and seafood
    d. Corps and remains
    e. Volatile or toxic substances, or dangerous materials such as explosives
    f. Things that generate odor, are unclean and rotten or likely to get damaged
       g. Illegal goods such as stolen items, firearms and swords or things that are or are likely to be used for a criminal, or items that are prohibited to possess based on laws and regulations
    h. The total length of height, width and depth of the luggage surpasses 200cm
    i. The weight of one piece of luggage surpasses 30kg
  4. Fees
    Fees for the use of the service shall be the fees stipulated by Mikuraya at the time of application and shall be paid along with the amount of the shipping fee to the return address. In addition, fees for the use of the service shall be calculated on a weekly or monthly basis.
  5. Inspection of stored items
    We may check a stored item (including inside the luggage) with the consent of a customer in case we deem it necessary in relation to the storage. In case we notify a customer of it and don’t have a reply within 7 days, customers will be deemed to accept and agree to it and we will check the stored item.
    In addition, in case a customer denies our checking a stored item, we may reject providing our temporary luggage storage service.
    Furthermore, in case we judge items specified in the previous clause “3. Things that cannot be stored are suspected to be included in the luggage, we may open/ inspect the stored luggage without the customer’s consent. Unlocking of the key to the luggage shall be consigned to a specified specialist.
  6. Period extension and handling of return
    (1) In case a customer wishes to extend the storage period longer than the period mentioned at the time of application, a customer must tell us the extended period a week before and pay for the extended portion.
    (2) In case a customer wishes to change the return address, a customer must contact us about the return address a week before.
    (3) In case a customer wishes to shorten the period for luggage storage, they must contact us a week before the return date. We cannot deal with an urgent offer to return luggage. We won’t adjust an account for the shortened period.
    (4) We deal with shipping to return luggage from Monday to Friday.
    (5) We shall return stored luggage in the same condition as it was received.
  7.  Handling of luggage when a customer doesn’t receive it after the use of the service
    In case we return luggage to a certain address and on a certain date that a customer has specified at the time of application and thus the luggage hasn’t been received and returned to Mikuraya and we cannot contact the customer, 30 days after the luggage is returned to us, the customer shall be deemed to have relinquished the ownership of the stored item which will be disposed of on our discretion without confirmation to the customer. The fees for storage during the term and disposal shall be charged to the customer.
  8. Our responsibility
    (1) We shall compensate for the loss and damages of the stored luggage arising from our negligence during storage at a maximum of 10,000 yen for one piece of luggage.
    (2) We shall exclude from the coverage damages that don’t impair the original function of the checked-in item such as dirt and scars that come naturally when it is checked in.
    (3) Our responsibility starts when the luggage is checked in and finishes when it is shipped to return it. Therefore, we shall not compensate for accidents that occurred during shipping.
  9.  Cancellation
    In case there are violations of the terms herein, refusal of inspections and payment default for storage fees, we shall cancel the agreement. In that case, we shall notify the customer of the cancellation of the agreement and the date of the cancellation by e-mail.
  10. Disclaimer
    In the case of the following items, we shall not take responsibility if losses or damages occur to a stored item.
    (1)  A customer checks in an item that is specified in “3. Things that cannot be stored”
    (2)  Force majeure such as disasters
    (3)  A stored item is confiscated or asked to submit as a piece of evidence by related government offices due to exercises of jurisdiction and so on.
    (4)  Others when liability is not attributable to Mikuraya
  11. In case a receiver changes and others
    In case a receiver changes due to death or for other reasons, a customer needs to submit a public document that shows the relationship between the customer and the changed receiver.
  12.  A user’s liability
    In case Mikuraya or a third party suffers damages due to a customer’s intent or negligence or because a customer doesn’t follow the terms and conditions herein, the customer shall compensate for the damage.
  13. Handling of Personal Information
    We shall use personal information acquired from customers in relation to temporary luggage storage only for its intended purpose.
  14. Governing Law
    The governing law shall be Japanese law.
  15. Agreement Jurisdiction Court
    Any disputes arising out of or related to this agreement will be submitted to the exclusive jurisdiction of Tokyo District (or Summery) Court.
  16. Revision of the terms herein
    The agreement may be revised at our own discretion on an irregular basis.
